Terms of Service for PokerBlitz

Important: These Terms of Service ("Terms") constitute a legally binding agreement between you and PokerBlitz. By accessing or using the PokerBlitz mobile application, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By downloading, installing, accessing, or using PokerBlitz (the "App"), you agree to comply with and be bound by these Terms of Service. These Terms apply to all users of the App, including but not limited to casual players, registered users, and participants in leaderboards and daily challenges.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

2. Eligibility

You must be at least 13 years old to use PokerBlitz. By using the App, you represent and warrant that:

You are at least 13 years of age
You have the legal capacity to enter into these Terms
You will use the App in compliance with these Terms and all applicable laws
If you are between 13 and 18 years old, you have obtained parental or guardian consent to use the App

We reserve the right to verify your age at any time and to terminate your account if we determine you do not meet the age requirements.

3. Description of Service

PokerBlitz is a free-to-play mobile card game that offers:

Fast-paced poker hand matching gameplay
Streak system with score multipliers
Daily challenges with unique objectives
Global and daily leaderboards
Achievement system
Offline play capability
Optional in-app advertisements

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice, and without liability to you.

4. User Accounts

4.1 Account Creation

Certain features of the App require you to create an account. When you create an account, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Maintain the security of your password and account
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

4.2 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violations of these Terms, fraudulent activity, or cheating. You may delete your account at any time through the App settings.

5. User Conduct and Prohibited Activities

You agree NOT to engage in any of the following prohibited activities:

Cheating: Use any hacks, mods, exploits, or third-party software to gain an unfair advantage
Harassment: Use offensive, inappropriate, or harassing usernames or communications
Impersonation: Impersonate any person or entity, or falsely state or misrepresent your affiliation
Manipulation: Manipulate leaderboards, achievements, or game statistics
Reverse Engineering: Reverse engineer, decompile, or disassemble any part of the App
Interference: Interfere with or disrupt the App or servers or networks connected to the App
Automated Access: Use any bot, spider, crawler, or automated means to access the App
Commercial Use: Use the App for any commercial purpose without our written permission
Data Mining: Extract, scrape, or harvest any data from the App
Illegal Activity: Use the App for any illegal or unauthorized purpose

5.1 Username Policy

Usernames must not contain:

Profanity, offensive language, or hate speech
Personally identifiable information (phone numbers, addresses, etc.)
Impersonation of others or brands
Spam, advertising, or promotional content

We reserve the right to change or remove any username that violates this policy.

6. Leaderboards and Rankings

Participation in leaderboards is subject to the following rules:

Scores must be achieved through legitimate gameplay
We reserve the right to remove scores that appear suspicious or fraudulent
Leaderboard positions are not guaranteed and may change based on other players' scores
We may reset leaderboards periodically (e.g., daily, weekly, monthly)
Your username and score will be publicly visible on leaderboards

7. Intellectual Property Rights

7.1 Our Rights

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, code, and software, are the exclusive property of PokerBlitz and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use, subject to these Terms. This license does not include any right to:

Resell or make commercial use of the App or its content
Download, copy, or distribute any content from the App
Make derivative works based on the App
Use any data mining, robots, or similar data gathering tools

7.3 Trademarks

"PokerBlitz" and related logos are trademarks and may not be used without our express written permission.

8. Advertising

The App may display advertisements provided by Google AdMob and other advertising partners. By using the App, you acknowledge and agree that:

Advertisements may be displayed within the App
Advertising partners may collect data as described in our Privacy Policy
You can opt out of personalized ads in your device settings
Rewarded video ads may provide in-game benefits (extra time, power-ups, etc.)
We are not responsible for the content of third-party advertisements

9. Third-Party Links and Services

The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party websites or services.

10. Disclaimers and Limitation of Liability

10.1 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

The App will be uninterrupted, secure, or error-free
Defects will be corrected
The App is free of viruses or other harmful components
Results obtained from use of the App will be accurate or reliable

10.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL POKERBLITZ, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of (or inability to access or use) the App
Any conduct or content of any third party on the App
Any content obtained from the App
Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE PAST SIX MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

10.3 No Gambling or Real Money

PokerBlitz is a game of skill and entertainment only. The App does not involve real money gambling, betting, or wagering. Scores, achievements, and virtual rewards have no real-world monetary value and cannot be redeemed for cash or prizes.

11. Indemnification

You agree to defend, indemnify, and hold harmless PokerBlitz and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

Your access to or use of the App
Your violation of these Terms
Your violation of any third-party right, including intellectual property, privacy, or other proprietary rights
Any claim that your use of the App caused damage to a third party

12. Data Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data collection and use practices.

13. Changes to the App

We reserve the right to:

Modify or discontinue any feature or aspect of the App at any time
Change game mechanics, scoring systems, or rules
Remove or reset leaderboards, achievements, or statistics
Change or remove any content within the App

We are not liable to you or any third party for any modifications, suspensions, or discontinuances of the App.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination:

Your right to use the App will immediately cease
Your account and all associated data may be deleted
You must cease all use of the App

All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Dispute Resolution and Arbitration

15.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us. We'll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or we may bring a formal proceeding.

15.2 Binding Arbitration

Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

15.3 Class Action Waiver

YOU AND POKERBLITZ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located within that jurisdiction for the purpose of litigating all such claims or disputes.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and PokerBlitz regarding the App and supersede all prior agreements and understandings.

19. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

20. Assignment

You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, without our prior written consent. We may assign or transfer these Terms at any time without restriction.

22. Acknowledgment

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE APP.
